What is a building permit and who issues them?
Building permits are documents that show that a building surveyor has approved building work prior to its commencement. The Building Act 1993 and Building Regulations 2006 legislate that most building work is subject to the issuing of a building permit, including most alterations, demolitions and removals. Building permits are issued by council planning departments or independent licensed building surveyors.
Do I need a building permit?
Undertaking building work without obtaining the necessary building permit is a serious offence and can result in severe penalties. The Building Act prescribes a penalty of $10,000 for any persons who carry out work without a permit. The Act and Regulations are important because they provide a system of control on building construction. They establish, maintain and improve standards for the construction and maintenance of buildings, enhance amenity and protect the safety and health of people using them.
What is the difference between a planning permit and a building permit?
Planning permits are the approval of ‘what’ and ‘where’ you want to build. They give approval for the use or development of land for a specific purpose. Building permits, on the other hand, give authorisation and focus on the construction or alteration of buildings, their structural safety and amenity.
Are there exemptions?
The building regulations recognise that some building work does not require a building permit. Examples of exemptions include pergolas associated with houses less than 20m2 in area; garden sheds with a floor area less than 10m2 and repair work done for maintenance purposes such as replacing rotted weatherboards.
How long does it take to obtain a permit? Do I have to pay for a permit?
The costs associated with a permit include an application fee and a building levy charge, calculated on the cost of works. Contact your council to find out how long it will take to process your application for a permit.
Do I need a permit to install solar panels and water tanks?
If your house sits in a heritage zone you may need a permit to install solar panels or water tanks. Check with your local council to avoid any issues.
When am I entitled to object to a proposed build?
During the planning permit stage you are able to lodge objections to a proposal. Local council websites give details on how to lodge your objection.
Are the building permit laws different for residential as opposed to commercial sites?
Two distinct Building Codes exist for residential and commercial construction. Your building surveyor can advise on each.
